1. Who we are

NordCierge ("we," "us") provides cinematic video production and web development services for businesses in Switzerland, across real estate, hospitality, restaurants, retail, weddings and events, and corporate/brand categories. These terms apply whenever you engage us for a project, from the point you accept a proposal through delivery.

2. Quotes & proposals

Submitting the quote form or receiving a proposal does not create a binding agreement. A project begins only once you've accepted a written proposal or statement of work covering scope, timeline, and price. Proposals are valid for 30 days from the date issued unless stated otherwise.

3. Payment

Payment terms (deposit amount, milestones, due dates) are set out in your specific proposal, not in these general terms — NordCierge's standard rate card is still being finalized internally as of this writing. Late payment may pause production or delivery until resolved.

4. What's included and what isn't

Your proposal states the specific deliverables covered. As a general rule, drone/aerial permits requiring special clearance, licensed music beyond a standard included track, and reshoots due to weather or client-side rescheduling are not included by default and are quoted separately if they apply.

5. Intellectual property & usage rights

Ownership of final delivered assets transfers to you upon full payment. Unless you tell us in writing that you'd prefer otherwise, NordCierge retains the right to use the work (in full or as excerpts) in its own portfolio, website, and marketing. Raw/unedited footage and project files remain NordCierge's property unless your proposal states otherwise.

6. Your content and rights

If you provide us with photos, footage, logos, or other materials, you confirm you have the right to share them with us and to have them used in the way your proposal describes. You're responsible for any third-party rights (e.g. a property you don't own, people who appear on camera) being properly cleared on your end.

7. Cancellation & rescheduling

Cancellation and rescheduling terms (notice period, any applicable fees) are set out in your specific proposal. Weather-related exterior reshoots are handled case by case and aren't automatically included in the original quote.

8. Confidentiality

We treat details of your project as confidential and won't share them beyond what's needed to deliver the work, except where you've agreed to be featured in our portfolio/marketing per section 5.

9. Liability

Nothing in these terms is intended to exclude liability that cannot lawfully be excluded under Swiss law. Beyond that, our liability for a project is limited to the amount paid for that project. This clause, and the governing law/jurisdiction clause below, have not been reviewed by a Swiss-qualified lawyer as of this writing — see the note at the bottom of this page.

10. Governing law

These terms are governed by Swiss law. The specific venue/jurisdiction clause is still being finalized — see the note below.

11. Changes to these terms

We may update these terms from time to time; the "last updated" date at the top of this page reflects the most recent revision. Changes don't apply retroactively to a project already under a signed proposal.

A note on where this document stands: this is a working draft, not a document reviewed by a Swiss-qualified lawyer. Sections 5 (IP/usage rights), 9 (liability — Swiss law restricts excluding liability for gross negligence, and this clause needs to reflect that correctly), and 10 (governing law/jurisdiction) in particular should not be relied on in an actual dispute until a real lawyer has reviewed them.
